I am curious the process many are using for their SBR registration, if you go that route?
Is filing a Form 1 the easiest? I heard this can take about a year after you send your 200 bucks in.
Thoughts?
for about $200 you can get an AR Pistol lower already built from psa, takes about a week…
Welcome to the forum! Yes, form 1 is the easiest route to go. If you do e-forms, it is significantly faster from submission to approval.
I have never done e-forms. All paper, with a trust. Mine have taken 10 months on average.
The old adage is, “The next 12 months will come and go regardless. Whether you have an approved stamp waiting for you at the end of it is up to you.”
I think current paper forms are arriving back in about 6.5 months. Check out the NFA Tracker website. I wish e-forms had existed when I did my sbr, took me 9 months for my first stamp.
I guess that I got lucky on all of my form 1 & form 4. I got all of mine back around the 4 to 5 month period. The best advice that someone can give you is to file the form 1 or form 4 and FORGET ABOUT IT. It will come when it comes. If the ATF says the current wait time is 6 months then don’t start calling them asking where you are in the process before 6 months. They were processing so many forms that they were supposed to hire several more agents to process the applications. E-file is was by far the quickest route when it was up and running properly.
Thank you for the reply and advice
I had read a little about a trust. Did you hire an attorney for this? I have 3 boys and numerous tools I would like to ensure are covered and protected should anything happen. They are currently under 18 so adding my wife is probably a smart plan as well.
That may be a smarter option. I have some uppers needing placement so these would come as a pistol purchase? I will check out the site some more. Thank you
I have the professional gun trust through David Goldman. He has different levels of trusts. He is widely known as having one of the best gun trusts and it is user friendly. His trust is specifically a gun trust and not a regular modified trust. Many lawyers can do trusts but not many can really do a straight gun trust. You can call or email and everything can be done online. I have a little over 200 items in my trust. I wanted to make absolutely sure that my trust was legal and iron clad. No since taking chances because if your trust isn’t completely legal and the ATF issues you a tax stamp you are still in violation of the law. You could be charged with a felony. With that felony you would loose the right to possess what you are trying to protect. Gun Trust - NFA Trust | Jacksonville Firearms Lawyers Law Office of David M. Goldman
Yeah. But he’s no longer practicing.
It’s worth it to get a trust for the reduced headache your heirs will have to endure after you take that long road home.
Trust is definitely the way to go. I amended my trust to remove my family after rule 41p was enacted. I submitted, and once I had my last stamp back I amended my trust to add them back.
The bad thing is that most of the cheap gun trusts aren’t properly set up to add and remove trustees after the trust is originally written… They give you the very basics just to get a tax stamp and that is it. If your trust isn’t specifically set up and written to allow you assign and remove trustees as part of the origional trust then again you are in violation of the law.
both of my SBRs took less than a month using Efile
here is the website i used https://eforms.atf.gov/EForms/faces/userProfile/login.jspx?_afrWindowMode=0&_afrLoop=254156994651154811&_adf.ctrl-state=1djqz4ui8y_4
its very simple, the difference is when you e-file a Form 1 you only get a e-stamp not a physical one like with a traditional form 4
you will need 2 fingerprint cards, they are $15 from SilencerShop if your in the system
Awesome. Thank you for that tip
its super simple
The Trust Shop is absolutely amazing for creating a trust and also goes step by step through the ATF forms.
Trust is definitely a good path. As for how long it will take - luck of the “draw” at this point. Many folks are getting e-file approvals in a month (+/- a few days or a week), many are getting stuck having to wait. While I can’t prove this, it seems the issue lies on the Fed Bureau or Inv. side and getting the background checks complete in a “timely manner”.
I have some form 4 stuff lingering. I have been in communication with my ATF rep and they have told me my paperwork is all good, just waiting on the BG check to complete. That seems to be a theme I have seen reported in quite a few places.
Anyhoo - Like 1911 said - File it and forget about it.
