I have a family friend who is wanting to purchase a PSA AR-15 for her husband as a Christmas gift.
Is it possible for her to order/purchase it in her name for him? I know that he will have to be the one to complete the background check in order to pick it up, but would it make a difference if the gun was purchased under a different name than his?
Most states allow familia transfers without background checks. For example, my boy couldn’t obtain a pistol from an FFL due to Federal Law and his age
I bought a Beretta APX and gifted it to him, perfectly legal in Colorado, even though he’s only 20
Check your local/state laws since you didn’t disclose a location
The only exception being if the person you’re gifting it to is a “prohibited person”

I’m in PA and I wanted to order my son a rifle online as a present, (he is legally allowed to own it) I ordered it in my name and he was going to do the background check and pick it up. The FFL I chose who I use quite often said “no way” as it must be shipped in to his FFL in my son’s name and picked up by him. So check with you receiving FFL and ask before you buy it.
So in the end, I did the background check in my name, and then legally gifted it to him. and it all worked out well.
So like I said and GG said, if it is legal to do so in your state, order it in your name, transfer it in your name, then legally gift it to the recipient if legal in your state
Maybe add the recipients name for the receipt. I would not transfer a weapon that has someone elses name as recipient. I transfer the weapon to the no name on receipt, then the recipient calls wanting their weapon. Im on the hook and then i get smashed by the feds. No thanks.
DO NOT say you are buying to gift to someone when you’re at the dealer. The transfer stops right there as that is considered straw dealing.
I think, not positive, you have to wait at minimum of 30 days to avoid the straw purchase. At least I remember reading that in one of the law, may have been My State Law, never done it, so I’m not positive
To be clear, there is no “registering” of firearms in TN. The only information captured is on the 4473 transfer form which stays with the FFL (limited personal information is used for the NICS check if needed). Hopefully, your friend did the 4473 to pickup the rifle. If not, then you have another set of problems.
People, this is not rocket science. Buy the gun and have it shipped in the payer’s name to the payer’s address. FF Licensees are only authorized to transfer the firearm to the person named in the shipment (you paid for it you bought it). Once the gun is in your house, any member of the household can be in possession. May god have mercy on your soul if your household is stupid. You may win a Darwin award. Look up Sandy Hook or the Parkalnd High School shooting. Both cases of mental defectives with guns. Possession outside the home: If you are an blessed with a drug conviction, jailed for domestic violence, are under indictment, have outstanding arrest warrants, or are a felon and you are caught outside the house with a firearm you are going to be arrested and charged as a prohibited person in possession. That carries two to 10 years round these parts.
After two being called for two jury pools for of this sort of thing, I’m not going to be happy.
