Found out today that this bill was written by Everytown, and that the Colorado legislature has every intention of fast tracking this bill and ramming this through.
I’ve fought against these bills with everything I have for the last 5 years. I’m getting tired.
We may need help from out of state residents because they claim that out of state residents are fueling gun violence in Colorado.
I did what I did before but what do I need to do now.

Gentlemen,
I am writing you being in solid opposition of SB25-003; Semi Automatic Firearms & Rapid Fire Devices.
This bill has been misrepresented as a way to close the “15rd magazine ban loophole”, legislation that was passed back in 2013.
That loophole simply does not exist. Current Colorado law is the current law. We can not pass legal legislation in our state based upon fear of what neighboring states allow. Enforce the current law while it still stands.
Interestingly enough, SB25-003 doesn’t address magazines at all. It instead bans semi automatic rifles, shotguns, even .22 caliber rifles, and carves out an interesting exception allowing the Attorney General of Colorado to single handedly determine the legality of firearms in the future, without constitutional passage of legislation. This is blatantly unconstitutional, allowing one person in Colorado to write law at their sole discretion. This is especially dangerous in writing laws that affect a constitutional right, without any checks or balances on this single person.
The “fixed” magazine firearms that are proposed replacements for the potentially banned semi auto firearms with detachable magazines, do not exist. They simply don’t exist, and manufacturers are very unlikely to produce “one off” guns to meet our unique state legislation, given our small population in comparison to say California.
While on the subject of detachable magazines, what is the VERY FIRST thing that you do when a firearm MALFUNCTIONS?
You remove the magazine of course. Why? For safety in clearing the malfunction. With a fixed magazine mandate, you are making for EXTREMELY unsafe conditions when a firearm malfunctions. I could see this mandate resulting in negligent death or injury lawsuits against the state because you forced a previously safe firearm to be forcefully converted into an unsafe firearm.
Semi automatic firearms of any type are in common usage, and have been for decades. This is beyond refute.
Should I refer you to Columbia v. Heller of 2008? The Supreme Court held (a) the Second Amendment protects an individual right to keep and bear arms that is NOT tied to militia member-ship; and (b) AN ABSOLUTE PROHIBITION OF A WEAPON IN COMMON USE FOR LAWFUL PURPOSES IS A PER SE VIOLATION OF THAT RIGHT. There are millions upon tens of millions of the firearms in common use, for lawful purposes. I believe that 300,000 is the threshold of common use as established by the Supreme Court.
This legislation as proposed is blatantly unconstitutional, ripe for a court challenge, and being overturned.
I will also refer you to the Supreme Court’s three part test that consists of the text of the Constitution, the nation’s history, and its traditions.
I don’t see anywhere in the pending legislation that passes this scrutiny, again making this ripe for legal challenge and overturning.
Gentleman, you may not like or agree with current firearms laws, but I would encourage you to work within the framework of existing legislation and the United States Constitution, rather than blatantly try to violate the law abiding gun owners’ rights for some small, temporary, political victory ensuring you some national news headlines for a few news cycles until the country moves on to the next “issue”.
Here’s a thought, instead of ramming through unconstitutional legislation that disproportionately affects law abiding gun owners who have never committed a crime in their lives, routinely pass 4473s, have been finger printed like criminals in order to obtain a CCW, instead of making their lives harder…
I’d propose much harsher penalties for firearms crime and sentencing enhancements.
Treat criminals that choose to use firearms like criminals, and respect your law abiding citizens and their constitutional rights, whether they own guns or not.
Like the last few years, I will be following along during all 6 phases of this legislation, protesting all the way. Just like the last two years.
I also find it extremely appalling and downright lazy that the Colorado Senate did not even write this legislation. It was written for them and provided by a specific anti gun group.
If I tried to pass off something at work that was written for me by another entity, I would be fired. I hope that my opinion of you here on passing off legislation of your own is crystal clear. It’s pathetic.

Was informed this morning Rhode Island is prepping up an AW ban as well. Anyone know of the language in that one?
They pushed through a mag ban limiting everyone to 10-rounders and a 1-week waiting period for purchases (unless you have a CCW) a couple years back. RI used to be pretty gun-friendly (you know, for New England) with the ability to get whatever you want, no mag limits, no waiting periods, etc.
With everything else, if they pass an AW ban, they’re no different than MA and CT, maybe worse in some aspects.
