As the person who started this post… I figured I would try again and I ordered a rifle kit Monday and received it Today. Ok… Now… How do I go about getting a sales tax refund. I have my order number. Its been 3 weeks.

PM @Anthony_PSA or @Josiah_PSA . They should be able to help you.

Correct me if I’m wrong but doesn’t the tax exemption only apply to complete firearms and ammunition? The law states “any portable firearm, designed to be carried and operated by a single person, including, but not limited to, rifles, shotguns, pistols, and revolvers, with no barrel greater than an internal diameter of .50 caliber or a shotgun of 10 gauge or smaller.” It also waives excise tax, which only applies to complete firearms. A rifle kit doesn’t meet that requirement as it’s not a firearm and the law doesn’t waive tax on individual parts.

Kits don’t count.

Only Firearms & Ammo. As another noted complete
Brass is not tax exempt, powder is not tax exempt, primers are not tax exempt.

A box or Case, or Pallet of Ammunition - is Tax exempt. (not individual components)

Whether that includes stripped recievers, i dont know.

I would venture to guess, if it needs a NICS &/or/both FFL transfer, then its tax exempt.

I figured, if it wouldn’t apply to a complete upper and a LBK separately it wouldn’t apply to a kit. Even though the tax exemption is a good thing PSA shouldn’t eat 6% of OPs purchases just because he doesn’t understand the law.

@Josiah_PSA I couldn’t figure out how to message you about refunding my sales tax. I sent a request in through the website.

@Josiah_PSA @Anthony_PSA My account is new so I couldn’t DM you about the sales tax issue. I just purchased a gun and I have my order number ready.

Thank you all in advance!

@Anthony_PSA @Josiah_PSA. Hello, I purchased an ar-15 a little while ago and noticed where I was charged WV sales tax. Is there any way I can get refunded? Thanks

@Josiah_PSA @Anthony_PSA y’all rock for doing this. I’ve bought a good bit without thinking about the sales tax however I’m about to pull the trigger on one of the new daggers. Would it be cool for one of you to DM me and then I can DM back my order info when I do order it?

As a WV resident, I ran into the same issue on being taxed on ammo on PSA a few days ago. I just got off the phone with a very nice PSA rep who told me they do charge WV state tax on ammo and its in their TOS. Im confused and disappointed. I dont get taxed on ammo when I order from midwayUSA or OP. Can somebody please explain why?

Thank you

Josh is no longer with the company, but perhaps @Josiah_PSA or @sean.psa can give you an explanation.

yes. They HAVE to charge sales tax, because there is no way to retro-actively alter whatever software they use/etc.

SO… that is why post-purchase, contact them & they will REFUND you the Sales tax.

Its a minor hiccup, but fair in my opinion.

I placed an order yesterday for ammo.
I contacted them today today via Chat, for a refund of the WV Sales Tax with the following reply.

"Thanks for contacting PSA! Please review the link regarding sales tax! https://palmettostatearmory.com/help-center/terms-and-conditions.html#special-tax-notices."

And the following in an e-mail.
“Thank you for your inquiry regarding the tax on your order. While your local state laws allow tax free purchases of firearms and ammunition, this is only for items purchased locally in your state. Our company is based in South Carolina, therefore it does not fall under this statue and we must collect SC state tax for your order.”

@HM_WV

Well that Sucks.
