Ny case

So since that went down, is everyone in the nation able to carry now? How does this affect other states? Do I still need to obtain a license in my state? Am i way off on this?

i know it will effect every state… and im not much more educated on it than that… however i do have a link to the actual decision to be read if you are interested.

the Supreme court’s decision : https://www.supremecourt.gov/opinions/21pdf/20-843_7j80.pdf

Unfortunately i think liberal states will still find ways to infringe on rights. All this truly does is take out the “just cause” requirement.

The evil left will always try to find a way to trample individual rights.

In the short term this ruling only impacts states with “may issue” laws where the government had discression in issuing carry permits. Most states are either constitutional carry or “shall issue”. However, in the long term, this ruling sets the stage for additional lawsuits against state laws which restrict 2A rights. Think magazine limits, rifle bans, ammo purchase licenses, etc.

unfortunately, they left a lot of holes in this decision that States will use to make it as difficult as possible to carry in these states:

ALITO:
Our holding decides nothing about who may lawfully possess a firearm or the requirements
that must be met to buy a gun. Nor does it decide anything about the kinds of weapons that people may possess. Nor have we disturbed anything that we said in Heller or McDonald v. Chicago, 561 U. S. 742 (2010), about restrictions that may be imposed on the possession or carrying of guns

KAVANAUGH:
First, the Court’s decision does not prohibit States from imposing licensing requirements for carrying a handgun for self-defense. In particular, the Court’s decision does not affect the existing licensing regimes—known as “shall-issue” regimes—that are employed in 43 States.

Justice Alito’s piece is a good read.

After all that, and the NY Guv is publicly losing her idiotic dang mind, all but lamenting the imagined Bloodflood in the Streets of NYC……

Kavanaugh, and his opinion is just that, it is not binding, says that he believes training requirements, licenses and permits all fit within the 2a.

My question is what about fees. There is no other right that requires a person to have to pay a fee in order to use it.

There is the catch 22 on the whole problem. Kind of like when they gave the ATF the ability to create laws on what is or isn’t legal. Slippery slope for sure. The new law that is going to the President includes more than a few controversial issues with the “Red Flag Laws” seems that you are guilty until you can prove innocent. No due process. If you haven’t noticed, most of this is going on in States with the highest crime rates. “Gun Free Zones” just ask for problems, hundreds of gun laws on the books, but nobody gets prosecuted for their crimes. I could tell you where the idea of the “Fee” came from, but it’s a very controversial issue. You can look it up for yourself. Maybe GOA or the NRA, or a couple of letters or calls to your Rep. will get some of these constitutional rights FEES changed or dropped. Imagine having to pay a fee to use the 1st amendment. A lot of people would go broke quick.

wwweeeellllll, some states do require you get a permit and carry liability insurance for organized events, including scheduled/organized protests which are clearly 1st amendment activities. If I remember correctly any organized/scheduled event on the National Mall requires them.

I think what is going to happen is they will go down the road CA just turned down and require liability insurance (which will be killed if it ever makes it to court), onerous training requirements with requalification every X number of months (not years), magazine limits, etc. This isn’t anywhere near over for these states.

Why not make firearms training a mandatory requirement to graduating High School? Are students today learning anything other than being an activist? They could learn a trade like an armorer or better yet work on getting their FFL.

We’ve had red flag law here in IL. Neighbor was shooting coons in his attic with a pistol from inside 2 mornings ago at 4am. Our town is 4 blocks long lol everyone heard lol nobody cares i guess, i dont anyway. Wonder if anyone has fallen to the red flag law here.

Yeah, a bit.
What happened is shall issue was affirmed.
So first you need to know what was in NY before this.
New York said in effect You must convince the Government you have a good enough reason to need to carry before you can carry. (So if you were rich enough & Democrat enough, you had a good reason, everyone else was screwed)
After the New York case, New York (and because it was a SCOTUS ruling ) & every other State, must now Start with the presumption that every adult has the right to get a CCP (Concealed carry permit) unless or until the State can show a reason why they can not.

In short last week you had to prove to New York you needed one, Now New York has to prove you can’t lawfully have one or else they must give/sell you one. . All the onus now falls to the State

I hope that helped.

Very helpful thanks

You can now display Like Jonny Ringo in the movie Tombstone

Be like Pancho, Wear your gun outside your pants, for all the honest world to see! I am in Arkansas, and sometimes open carry because I can, like a lot of others here. After a few months, no one even notices, becomes a non-issue.

I am yet to see anyone open carrying in South Carolina even though we can.

Same.

the key is not to ask permission
