So the bill got signed that we can use suppressors while inside of the state of Texas, that are made in the state of Texas - without the $200 tax stamp and without registration.
Anybody know who manufactures these in Texas? Or who is tooling up to do so?
That’s going to be an interesting battle to see who goes first. The feds are going to hammer that person hard.
I hope there will be one in or near San Antonio - I don’t want to order online. I want to walk in and pay cash - the feds can take their receipts and not have names of customers.
I unfortunately don’t see a brand name suppressor company doing it. A new start up? Maybe. Some local redneck who hates the fed? Probably. But even then the fed can claim they arnt an ffl 07, and I don’t see any 07ffl’s putting their business on the line.
Perhaps AutoZone or O’Reilly’s will start selling 80% suppressors?
There are a lot of unknowns and potential traps on that right now. I would stay away until some legal presidents have been set on the issue.
Why don’t you just build your own? It’s not that difficult.
The law only means at this point that Texas law enforcement authorities will not be able to place you under arrest for not following federal law on in-state built suppressors. If the ATF chooses to come into the state and start looking at suppressors for stamps you will still be able to be charged by the federal government regardless of where it is built.
It is an attempt to use the interstate commerce clause of the constitution, but it is going to get a very large fight from the federal govt.
Is it a pain to wait for your can? Sure it is. Is the NFA just a "poll" tax? Sure it is, but it's not worth being the the first one to test the law. Lots of Jail Time and Lots of Money.
I think you’re correct in your explanation of what the Feds could still come in and do - and how Texas is trying to get around that.
I believe the best advice is to wait for the court case that will be filed to “find out” if we can do this or not. (I forget what it’s called, that a case actually gets requested, before anybody has been charged with anything.)
Buy the parts from amazon and build it yourself in Texas. Boom !! Texas built
I believe the law as written says that parts must be from Texas…
“MADE in TEXAS” Suppressors.
THE BILL: READ THE TEXT! Don’t guess, KNOW THE LAW!
As for Suppressor Manufacturers IN Texas? For one: http://www.pulleymarketing.com/rebel/sos-22/
THAT will get you jail time!
Do NOT guess! READ THE LAW! KNOW the LAW!
Bill Text: TX HB957 | 2021-2022 | 87th Legislature | Introduced | LegiScan
It is the duty of out elected officials to walk us through the legislation.
Please don’t spam the forum.
I am in contact with Texas State Representative Oliverson’s office, the bill’s author, in regards to the remarkable job their office did in providing further freedom and liberty to all Texans and that I am driven walking this legislation through to completion of a “Made In Texas” suppressor. I also advised the Honorable Mr. Oliverson to amend the bill to add: “Laser Etching” to the marking of the suppressor.
For those in doubt, you may want to review: Amendment X: The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
Gregory - do you know if this has happened yet? As I read this, it is saying that our AG is basically looking for a “first case” - BEFORE anyone gets charged with anything - to get the federal courts to give their confirmation.
" Sec. 2.054. ATTORNEY GENERAL. On written notification to
the attorney general by a United States citizen who resides in this
state of the citizen’s intent to manufacture a firearm suppressor
to which Section 2.052 applies, the attorney general shall seek a
declaratory judgment from a federal district court in this state
that Section 2.052 is consistent with the United States
Constitution."
Don’t see much difference in this and states that allow pot - still against federal law but a new industry has cropped up (pun intended) to service them. How are banks getting around processing those payments or business account? Isn’t that drug money?
The difference is votes. Gun owners don’t vote Democrat. Pot heads do, so the fed don’t care about that.
At least in Colorado, banks aren’t processing payments. It’s literally an “all cash” business, and business owners have literally run out of places to store cash.
It’s a problem.
